If MLB investigators determine that Rodriguez and his representatives interfered with their ongoing Biogenesis investigation, the struggling superstar could face additional discipline to the drug suspension he is already expected to receive.
Commissioner Bud Selig’s office could invoke what is known as the “just cause” clause of Article XII of the collective bargaining agreement if its investigators determine that A-Rod and his reps purposely interfered with the investigation into what is believed to be one of the biggest steroid scandals in sports. The probe involves as many as 20 players baseball believes could be in violation of its drug policy.
That clause, listed under “Conduct Detrimental or Prejudicial to Baseball,” says “players may be disciplined for just cause for conduct that is materially detrimental or materially prejudicial to the best interests of Baseball including, but not limited to, engaging in conduct in violation of federal, state or local law.”
“My understanding is they’re all over this,” said one of the sources familiar with baseball’s investigation. “They believe the standard ‘just cause’ claim in the basic agreement allows them to do this. This has been going on for a while.”
